These Terms & Conditions apply to your access to and use of ColourMe, Color Me In, our websites, upload tools, digital colouring studio, checkout flow, digital downloads, printed products, and related support services (together, the "Service"). In these terms, "we", "us", and "our" refer to the owner and operator of the Service. "You" means the person using the Service or placing an order.

1. Agreement to Terms

By accessing the Service, creating an account, uploading photos, generating colouring pages, or placing an order, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, you must not use the Service.

If you use the Service on behalf of a family member, child, business, organisation, or another person, you confirm that you have authority to do so and that you are responsible for their use of the Service.

2. Eligibility and Account Security

You must be at least 18 years old, or have the consent and supervision of a parent or guardian, to place an order. You are responsible for keeping your account sign-in details secure, for all activity under your account, and for making sure your email, delivery address, and order details are accurate.

3. Uploaded Photos and Your Responsibilities

You retain ownership of the photos and other content you upload. You are solely responsible for ensuring that you own, or have all rights, permissions, and consents needed to upload, process, transform, print, store, and use that content through the Service.

This responsibility is especially important for photos of children, family members, other people, private locations, copyrighted images, professional photography, school photos, sports photos, event photos, logos, characters, artwork, or any content created by someone else.

By uploading content, you grant us a worldwide, non-exclusive, royalty-free licence to host, copy, process, transform, display, store, transmit, generate derivative colouring-page outputs from, print, and otherwise use your uploaded content only as reasonably necessary to provide the Service, fulfil orders, operate and secure the platform, provide support, resolve disputes, prevent fraud or abuse, and comply with law.

4. Prohibited Content and Conduct

You must not upload, generate, request, share, or use the Service for content that:

  • you do not own or do not have permission to use;
  • is explicit, pornographic, sexually suggestive, exploitative, abusive, or unsafe for children;
  • depicts or promotes child sexual abuse material, grooming, exploitation, or non-consensual intimate content;
  • is hateful, harassing, threatening, defamatory, discriminatory, violent, or otherwise harmful;
  • infringes copyright, trade marks, privacy, publicity, moral rights, or other rights;
  • contains malware, attempts to disrupt the Service, or is used for scraping, automated abuse, fraud, or security testing without permission; or
  • is unlawful or encourages unlawful activity.

We may refuse, remove, block, delete, or report content or accounts where we reasonably believe there is a safety, legal, security, intellectual-property, payment, or platform-integrity concern. We may cooperate with law enforcement, regulators, payment providers, hosting providers, and child safety organisations where required or appropriate.

5. AI Generation and User Review

The Service uses automated and AI-assisted tools to transform photos into colouring pages. Outputs may be stylised, imperfect, incomplete, delayed, inaccurate, or unsuitable for your intended use. You are responsible for reviewing previews, page selections, names, delivery details, and final order choices before purchasing, downloading, printing, or sharing any output.

We do not guarantee that generated pages will match a source photo exactly, preserve every detail, or meet a particular artistic, educational, commercial, therapeutic, accessibility, or printing requirement.

6. Prices, Payments, and Promotions

Prices, inclusions, discounts, promotion codes, trial credits, taxes, delivery fees, and product availability may change from time to time. Any estimate shown before checkout is informational only. The final payable amount is confirmed during checkout and payment processing.

Payments are processed by third-party payment providers such as Stripe. We do not store full card numbers. You must provide accurate payment and billing information and must not use a payment method without authorisation.

7. Digital Products, Printed Products, and Delivery

Digital products may be generated, accessed, downloaded, or delivered electronically. Due to the nature of digital products and custom-generated content, digital orders are generally not refundable once generation, access, or delivery has started, except where required by law or where we determine there has been a verified technical fault that prevents reasonable use.

Printed products, where available, are custom goods made from your approved content. Colours, cropping, paper finish, margins, binding, and print results may vary between screens and physical products. You are responsible for checking the preview and providing accurate delivery details before checkout.

Delivery dates are estimates only. We are not responsible for delays caused by postal carriers, customs, incorrect addresses, failed delivery attempts, force majeure events, or matters outside our reasonable control. If a printed item arrives damaged, you must contact us within a reasonable time with photos and order details so we can assess replacement or refund options.

8. Refunds, Cancellations, and Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted, or modified.

Subject to your non-excludable legal rights, refunds or cancellations may be refused where an order has already entered generation, digital access has been provided, a digital file has been delivered, or a custom printed product has entered production. We may offer fixes, regeneration, replacement, credit, or refund at our discretion and as required by law.

9. Service Availability and Storage Limits

We may update, suspend, restrict, or discontinue any part of the Service at any time. Uploads, generation, previews, downloads, the digital colouring studio, support tools, and stored drafts may be unavailable, delayed, limited, or deleted due to maintenance, security, storage limits, third-party provider issues, abuse prevention, or expiry policies.

10. Our Intellectual Property

The Service, including our software, interface, branding, templates, workflows, prompts, generated page layouts, copy, designs, icons, and other materials, is owned by us or our licensors and is protected by intellectual-property laws. You must not copy, reverse engineer, scrape, resell, or misuse the Service except as permitted by law or with our written permission.

11. Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold us harmless from claims, losses, liabilities, damages, costs, and expenses, including reasonable legal costs, arising from your uploaded content, your breach of these Terms, your misuse of the Service, your order details, your violation of law, or your infringement of any third-party rights.

12. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive loss or damage, loss of profit, loss of data, loss of goodwill, business interruption, or claims arising from third-party services.

To the maximum extent permitted by law, our total aggregate liability for claims connected with the Service is limited to the amount you paid us for the order or Service giving rise to the claim, or AUD $100 if no amount was paid. This limitation does not apply where it cannot lawfully apply.

13. Termination

We may suspend, restrict, or terminate your access to the Service at any time where we reasonably believe you have breached these Terms, created risk for us or others, misused payments or promotions, uploaded prohibited content, or where suspension is required for security, legal, or operational reasons.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth courts of Australia.

15. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with an updated date. Continued use of the Service after changes take effect means you accept the updated Terms.
